Liability for content (Haftung für Inhalte)

As a service provider we are responsible for our own content on these pages in accordance with general legislation pursuant to §7 (1) TMG / §7 (1) DDG. According to §§8–10 TMG / §§8–10 DDG, however, we as a service provider are not under obligation to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information under general legislation remain unaffected by this. A liability in this regard is, however, only possible from the point in time at which a concrete legal violation becomes known to us. Upon becoming aware of corresponding legal violations, we will remove the content immediately.

User deployments are third-party content. In particular, any application, website, API, media file, dataset, model output, or agent-generated artefact that a user deploys, uploads, or causes to be served via the Service is third-party information under §§8–10 TMG / §§8–10 DDG. We host such content as a hosting / caching service in the sense of §10 TMG; we do not author, curate, endorse, moderate, or pre-screen it. The user operating the deployment is the publisher and is responsible for compliance with applicable law (including but not limited to copyright, trademark, criminal-content statutes, consumer-protection law, and data-protection law). Visitors of a deployed application interact with that user, not with nyxory GmbH.

Liability for links

Our offer contains links to external third-party websites over whose contents we have no control. Therefore we cannot accept any liability for these external contents. The respective provider or operator of the linked pages is always responsible for their content. Linked pages were checked for possible legal violations at the time of linking. Illegal contents were not recognisable at that point in time. A permanent monitoring of the contents of linked pages is, however, not reasonable without concrete indications of a legal violation. Upon becoming aware of legal violations, we will remove such links immediately.

Notice and Takedown

Notices regarding allegedly illegal content (copyright, trademark, defamation, criminal content per §§ 86, 86a, 130, 131 StGB or comparable, etc.) should be sent to abuse@nyxory.com. Please include:

• The exact URL or resource identifier of the affected content
• The legal claim (right invoked, jurisdiction, statute)
• Identification of the rights-holder and contact information
• A statement under penalty of perjury that the information in the notice is accurate

We aim to respond within 72 hours.
